Terms and conditions of the online store

Introductory provisions

The Internet Store of the Counselling Centre I Feel Good, available at the Internet address https://czujedobrze.pl/ and https://schematowa.com/ is run by Iwona Łaskarzewska conducting business activity under the name of I Feel Good Psychotherapy Iwona Łaskarzewska, registered in the Central Register and Information on Business Activity (CEIDG) maintained by the Minister responsible for economy, NIP 1231539432, REGON 526223247.


These Regulations are addressed both to Consumers and Entrepreneurs using the Store and define the rules for the use of the Online Store and the principles and procedure for concluding Distance Sales Agreements with the Customer through the Store.

Definitions

Consumer – a natural person performing a legal transaction that is not directly related to the consumer's business or professional activity.


Seller - a natural person conducting business activity under the name Czuję Dobrze Psychoterapia Iwona Łaskarzewska, entered in the Central Register and Information on Economic Activity (CEIDG) kept by the minister responsible for the economy, NIP 1231539432, REGON 526223247.


Customer - any entity making purchases through the Online Store.
Entrepreneur - a natural person, legal person, and organizational unit that is not a legal person, to which a separate law grants legal capacity, conducting business activity on its own behalf, which uses the Store.


Store - an online store operated by the Seller at the following internet addresses: https://czujedobrze.pl/ and https://schematowa.com/.


Distance contract - a contract concluded with the Customer within an organized system of distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract.


Terms and Conditions - these Terms and Conditions of the Store.
Order - a declaration of will made by the Customer using the Order Form (Reservation) and aimed directly at concluding a Product (or Products) Sales Agreement or a Service (or Services) Sales Agreement with the Seller.
Account – a customer account in the Store (or service booking system), which stores data provided by the Customer and information about Orders placed by them in the Store. Registration form – a form available in the Store (or service booking system) that allows you to create an Account. Order form - an interactive form available in the Store (or service booking system) enabling the placement of an Order, in particular by adding Products to the Shopping Cart and specifying the terms of the Sales Agreement, including the method of delivery of the product or performance of the service and payment. Shopping Cart – an element of the Store's software (or service booking system) in which the Products or Services selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order details, in particular the quantity of products or services. Product – a service or electronic product available in the Store that is the subject of the Sales Agreement between the Customer and the Seller. Sales Agreement – an agreement for the sale of a Product concluded between the Customer and the Seller via the Online Store (or service booking system). The Sales Agreement is also understood – depending on the characteristics of the Product – as an agreement for the provision of services, which is included in the Terms and Conditions of the Facility.

5. The Customer may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.
6. The Customer may communicate with the Seller by telephone between 10:00 a.m. and 6:00 p.m.

Technical requirements

To use the Store, including browsing the Store's assortment and placing orders for Products, you must:

  1. a terminal device with access to the Internet and a web browser such as Chrome, Firefox, Opera, Safari, Samsung Internet or Edge,

  2. active e-mail account,

  3. cookies enabled .

General information

1. The Seller, to the fullest extent permitted by law, shall not be liable for any disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
2. Browsing the Store's assortment does not require creating an Account. Customers may place orders for Products in the Store's assortment either by creating an Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data to enable Order fulfillment without creating an Account.

3. Prices listed in the Store are given in Polish zloty and are gross prices (including VAT).

Creating an Account in the Store

1. To create an Account in the Store, complete the Registration Form. The following information is required: first name, last name, email address, and phone number, as well as a contact address for the purpose of issuing sales confirmations. The sales confirmation is not a fiscal receipt, but a document confirming the conclusion of an electronic sales contract.
2. Creating an Account in the Store is free.
3. The Customer may, at any time, without giving any reason and without incurring any fees, delete the Account by sending an appropriate request to the Seller, in particular via e-mail or in writing to the addresses provided in the " Contact the Store " section.

Rules for placing an Order

To place an Order you must:
1. select the Product that is the subject of the Order and then click the "Reserve" button (or equivalent);
2. log in or use the option to place an Order without registration;
3. if you have chosen to place an Order without registration - fill out the Order Form by entering the details of the Order recipient and select by clicking the method of service provision (Order) or enter information about the address to which the Product is to be delivered, and then select the type of shipment (method of delivery of the Product), enter the invoice details if different from the details of the Order recipient,
4. click the "Order and pay" button,
5. select one of the available payment methods and, depending on the payment method, pay for the order within a specified period, subject to point 3 of the paragraph "Offered delivery and payment methods".

Delivery and payment methods offered

1. The Customer may use the following methods of delivery or collection of the ordered Product: Delivery of the electronic product to the e-mail address provided in the Form.
2. The customer can use the following payment methods:
a. Payment by transfer to the Seller's account,
b. Electronic payments.
3. Detailed information on delivery methods and acceptable payment methods can be found on the Store's website.

Execution of the sales contract

1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form in the Online Store in accordance with the paragraph "Rules for placing an Order" of these Regulations.
2. After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt of the Order and its acceptance for processing occurs by the Seller sending the Customer an appropriate email to the Customer's email address provided when placing the Order. The email message contains, at a minimum, the Seller's statement of receipt of the Order and its acceptance for processing, as well as confirmation of the conclusion of the Sales Agreement. Upon receipt of the above email by the Customer, a Sales Agreement is concluded between the Customer and the Seller.
3. If the Customer chooses payment by bank transfer or electronic payment, the Customer is obliged to make the payment within 1 calendar day from the date of conclusion of the Sales Agreement - otherwise the order will be canceled.

Right of withdrawal and Complaints

1. The Sales Agreement covers new digital Products.
2. The right to withdraw from a distance contract does not apply to the Consumer in relation to the Contract:
a. for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the commencement of the service that after the Seller has performed the service, he will lose the right to withdraw from the Agreement,
b. for the delivery of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the Consumer before the expiry of the withdrawal period and after the Seller informed him of the loss of the right to withdraw from the Contract.
3. In the event of a defect in goods purchased from the Seller, the Customer has the right to make a complaint based on the warranty provisions of the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.
4. Complaints should be submitted electronically to the Seller's addresses provided in these Regulations. It is recommended that the complaint include, among other things, a concise description of the defect, the circumstances (including the date) of its occurrence, the details of the Customer submitting the complaint, and the Customer's request regarding the defect of the goods.

Out-of-court ways of dealing with complaints and redress of grievances

1. Detailed information on the possibility for Consumers to use out-of-court complaint handling and redress procedures, as well as the rules for accessing these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and at the following websites of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.

2. The consumer has the following examples of options for using out-of-court complaint handling and redress procedures:

a. The consumer is entitled to refer the matter to a permanent consumer arbitration court referred to in Article 37 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle a dispute arising from the Agreement concluded with the Seller.

b. The Consumer shall be entitled to refer the matter to the provincial inspector of the Trade Inspection, in accordance with Article 36 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for the amicable settlement of the dispute between the Consumer and the Seller.

c. The Consumer may obtain free assistance in resolving a dispute between him/her and the Seller, also using the free assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., the Consumer Federation, the Association of Polish Consumers).

3. In addition to the above-mentioned institutions, the Consumer may use current, publicly available online platforms offering mediation or support in consumer disputes, if such platforms appear as a result of legislative or organizational changes.

Personal data in the Online Store

1. The administrator of Customers' personal data collected via the Online Store is the Seller.
2. Customers' personal data collected by the administrator via the Online Store are collected for the purpose of implementing the Sales Agreement and, if the Customer consents, also for marketing purposes.
3. The recipients of personal data of Customers of the Online Store may be:
a. In the case of a Customer who uses electronic payments or payment cards in the Online Store, the Administrator makes the collected personal data of the Customer available to the selected entity handling the above payments in the Online Store.
4. The Customer has the right to access and correct his/her data.
5. Providing personal data is voluntary, however, failure to provide the personal data specified in the Regulations and required to conclude the Sales Agreement will result in the inability to conclude the agreement.

Final Provisions

1. Agreements concluded via the Online Store are concluded in Polish.
2. The Seller reserves the right to amend these Terms and Conditions for important reasons, including: changes in legal regulations, changes in payment and delivery methods – to the extent that such changes affect the implementation of the provisions of these Terms and Conditions. The Seller will notify the Customer of any changes at least 7 days in advance.
3. In matters not regulated in these Regulations, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of services by electronic means; the Act on consumer rights, Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
4. The customer has the right to use out-of-court complaint and redress procedures. To do this, they can submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
